LMRA rules in favour of ‘mistreated employee

’Posted on : 2012-09-12
An Indian Engineer, who was slapped with an ‘illegal status’ and ban on mobility by his sponsor, said that he received a favourable verdict from Labour Market Regulatory Authority (LMRA).

According to V N Rengarajan, his written appeal to the LMRA CEO Ausamah Al Absi dated June 26 was ‘impartially scrutinised’ according to the rules. The verdict dated July 18 stated that the offence slapped on him was removed.

DT had reported in the month of June that Rengarajan accused his sponsor of plotting against him and urged officials to remove his illegal status and clear the mobility ban he received. He alleged that his sponsor has not paid him salary for a month, harassed and tortured his family. He said he was criminally misrepresented, threatened and finally framed ‘illegal’ through a forged complaint.

The employer – the owner of an electrical equipment company in Bahrain where Mr Rengarajan worked – had then told DT that he intended to file a defamation suit. He had said that he had valid documents as evidence which the employee had used against him and his company.

“I was forced to leave the country due to further harassment of the sponsor while the case was at LMRA, but I am happy my wait was worth,” Mr Rengarajan told DT from India

“I am extremely grateful to Mr. Al Absi for his serious, kind and impartial scrutiny and giving a verdict favouring justice. The case is in labour court for compensation and proceedings are going on. I understand that LMRA is yet to take action as per their procedure to sue the employer in court for having made false claims and thereby leading to even suspension of business, according to the verdict,” he said.

“I was intimidated by strangers allegedly sent by the sponsor. In view of safety to my life and family, I had to go to India at one point of time. The sponsor even threatened me in India, for which I am lodging a complaint appropriately,” he added.

At present, Mr Rengarajan is eligible to come back to Bahrain with new work permit immediately and said that he hoped justice would prevail in labour court as well.

The company owner could not be contacted for comments.

I wanted to enquire if a claim is lodged against the employer but the employee does not have Finances for court proceedings. What would be done then?

  2. I am currently working in a Contracting Est. for 20 months now, and hopefully ended my contract in 4 months time. Even I know that I am entitled to mobilized after my 12 months, I still continue my work in the current company because I am confused about the rule of local hiring. As per my contract is ending on October, I am very determined to transfer now. Is my current employer can demand me to be renewed or else banned me for mobility? What should I do to allow myself from searching for another job without being sent back to my country after my contract here?

  3. I just have taken mobility,as my first sponser was not able to pay my salary and cancelled my visa, now I just wanted to know how many time i can extend my mobilty til i gt a new job

  7. Sir
My new sponsor applied for my visa and I want to chek my status in LMRA, how can I check it without application ID because the new employer apply for me whenever I chek it by cpr or passpt it shown my current visa not my status of the new sponsor application

  8. Dear Sir,

I have been as an accountant at an entity for 1 1/2 years, receive salary of BD 450. This BD 450 is divided into basic salary BD 355, housing BD 60 & transport BD 40 in my offer letter which both parties agreed & singed. Two months later my sponsor (boss) reduced by basic salary as BD 200 which is mentioned only in salary sheet, but BD 355 in my offer letter & here no contract or agreement from my entity. My boss has a practice of paying employees vacation money on their basic salary without full salary. My clarification is that vacation money based on basic salary or full month (gross) salary as per law????. In addition my boss is always telling no employees are paid their indemnity when ending their service, is right as per law?

Kindly resolve this issue in order to obey the labour law.

    Hope your timely advice.

    Thanks.
    Manoon

  11. Dear sir:
I would like to seek clarification,
Why does Bahrain authorities issue Residency permit before the employee enters the country? Even before medicals, meeting the company staff etc

What is the legal status of an employee if he does not want to work, if he is ill treated right from
Entry point – Airport in Bahrain? Legally one is not an employee unless the person has worked at least 1 day?

Is there a way to get request RP cancelled from outside Bahrain?

Why does cancellation need sponsors signatures, when in an dispute sponsor will not sign?

    Thank you

  16. Dear sir
I am working in a company last 7 years. still the visa is valid for few more months. Now I got another offer from other company. but i am afraid to inform my current employer (he is the owner) to leave the job. If i go for the new job without the consent of current employer as per LMRA rules, then from the old sponsor there is any possibilities for making fake case against me or any other kind of ban for applying new visa and let me know the passport how I can take it from him.

Let me know if they send back to my home country after cancellation of my visa, can I come out from the Bahrain airport If I have another offer and mobility, because the passport they will give directly to the emigration in the airport only

thank you and waiting for the Kind reply
