What to do in case Employer has taken the passport and refusing to give it back

My employer/sponsor has taken my passport and is refusing to give it back to me even after I demanded it, citing that it is ” a company policy” or that it is detained for”safe-guarding”

Although this is out of LMRA’s jursidication, please note that the laws of Bahrain stipulate the following:

  • Without a court order, an employer has no right to hold employee’s passport whatsoever. That practice represents a violation of freedom of movement in contravention of Article (19) (b) of the constitution, which ensure the freedom of movement of every person on the territory of Bahrain.
  • This practice (although quite common) amounts to criminal misappropritation and breach of trust i.e the employer got the passport lawfully (in order to process the residency permit and other formalities etc.) but retained it unlawfully (without the employee’s consent).
  • The passport is a personal property, and is to be posessed solely by its rightful bearer/citizen. Also note that most passports clerly mention, ‘this passport is the property of the issuing government” therefore, no other party should be holding it.
  • If the employee demands his passport back and the employer refuses to hand it over (in writting if possible), the employee should first contact at the ministry of justice (diplomatic area).
  • Some employers/managers claim that this is the company’s policy or that they did not receive any official letters about that!
  • Claiming ignorance of the law does not relieve the management from its legal responsibility. Laws must be followed once they are approved by the officials and published in official gazette.
  • Companies’ internal polices must not contradict with the law, and any policy or practice deemed as illegal must be immediately abonded.

  1. Thanks for the information. However, I must point out that this is not sufficient to bring such situations to a closure. This information also does not provide a point-wise agenda to follow in case of trouble.

    I am aware of at least one situation where upon demanding the passport back, the employers not only refused to give the passport back, but also threatened that if the employee took any legal action, they will be in a position to create trouble for the employee such that the employee will face legal trouble, and will be unable to leave the country at all. The threat basically meant that the employer will file a false complaint of theft or other such crime against the employee by framing a false case.

        when I came here in Bahrain he /my employer didn’t give me cpr like 3 month.But which day I came after one one day he took my passport and he didn’t given back yet my passport. when I came here after 5 momonth he called me in his office then he told me give sign here in here in salary sheet for 24 month. he forced me he told me if i don’t sing here he will cancel my visa. then I sign there in salary sheet together 24 month. And after 17 month he cancel my visa. now I got an offer letter but he is not giving my passport. he asking money 300BD.before he asked 45BD he told if I give 45BD he will give me passport but when I gave 45BD he asking now 300BD.
        but I don’t know how I will get my passport. I don’t have any money. how much I have money he took all 45 BD he took already asking more 300BD.

    • My imployer she return me back to Agency its because i work with her in 3months shes not giving my salary. so what i did is complain in labor again to may sponsor. after that my sponsor she knows that about labor she retun me back to my agency and not return my passport. and she said she give me back may passport if i will pay her 800bd. but how can i pay her i got no money? what should i do can u give me idea about this case? now she give me warning if i dont pay her she will complain run away

    • Hi sir.. My employer took my passport from day 1 when i reached bahrain.. I worked with him fro 2 years and when I wanted to transfer to another job, he wanted me to sign a paper saying that I already received all my rights( which includes salary, passport, indemnity, ticket etc) and then he will return my passport.. I didnt sign because I haven’t receive my rights and I want them so my employer didnt return my passport and I filed a case for him in min of labour and the case got transfered to min of justice. But I think the judge and the people in the ministry only believes local people more than expats. My employer denied that he has my passport and I lost the urgent case I filed. Come to think of it, Why would an expat complain that the passport was held by the employer if it is with the expat himself? It will be just a waste of time and money for the expat if he/she is just lying about his/her passport being taken by the employer. The problem here, if you are an expat and you don’t have papaer evedence that the passport is woth the employer, they will take you for granted which happened to me. I don’t know what to do now because I’m supposed to get new visa from my new employer but my old employer doesnt want to give me release too.

  3. @wilfred, its frustrating to know that you already in Philippine Embassy for 9 months and they can’t act on your case. You mentioned that you have won the case (in what institution?) If you through the legal institutions of Bahrain then i guess you can go and check with them (Min of Labor or Min of Justice) of the next step if incase our Embassy can’t do anything.

    If the employer was not acting on your case then i suggest that you go back to the bahrain institution where you won your case and let them do the proper action regarding your employer.

    Really it was frustrating to know this kind of matter.

I have got skin problem (psoriasis problem). In oman, its medically accepted. what about in Bahrain? is Psoriasis problem medically accepted in Bahrain?

  5. This is only a law but reality differ. All passports taken by Sponsor when employer reached Bahrain. 99.99% passport with the sponsor and authority also know that but not taking any action. I know authority will tell to complain but if u complain then sponsor will cancel ur visa and he will send back u to home.

  6. yes thats true ….. im working here in chocolove cafe, budaiya … it is very difficult for us to borrow our pasport from our employer … i would suggest that the LMRA should have a routine inspections and personally check the indivivual pasport of the employees if it is on their hands …

  7. The law is not sufficient in itself. The employer’s in Bahrain refuse to give the passport and threaten the employees that a false case will be lodged against them. The Employee is in no position to protest or lodge a complaint against powerful employee. We do appreciate the work done by LMRA but there is no mechanism to check the erring companies who holds the employee’s passport and salaries.

LMRA support is highly appreciated and in the subjected matter, even though this is out of LMRA’s jurisdiction, and as the laws of Bahrain stipulate this, it makes a big difference if LMRA with reference of Bahrain’s Law, makes sure to convey and emphasis on the passports holding right to the employers / sponsorship not to hold to avoid any legal implications. Many a time as there is no penalties / punishment against such offenses, people tend to hold for nothing till they are warned strictly by authorities which they least bother about. Here majority is taken such issues and rights for granted!

  13. I work before 2yrs. And 10month in Bahrain as a nanny. I termanate my contract coz of misunderstanding with my employer. I sign a new contract before I got a vacation last January 2015. I went back to them February then got sick very sick (gallstone) they never mind so I ask if they can send me home. April I got my ticket and went back to my country. Now I apply as cleaner I got my visa but my agency tell me I’m lifetime ban in Bahrain and my old employer didn’t release me so they can’t get a job order and contract for me. I’m so confused howcome they get a visa and can’t get me a contract. Can my old employer block me for life time? If my case is just a bridge of contract. I’m already one year here in my country and my visa in my old employer will expired june 1, 2016. Plz. Do help me I’m very confuse thank for any reply.

    i have submitted my resignation one month before, now my company not paying my full and final settlement, they said they can give 30% amount now and rest of my settlement amount they will pay my bank account number in India and they said they will provide some legal documents for this amount.

    I am Hom Bdr Dahal from Nepal. I came in Bahrain with my family on 9 june 2016 as a light driver.When I came here the sponsor transferred me to the another company and also transferred my wife to the house as a housemaid . I was not agree for that.

    After two month I brought my wife with me. My visa has transferred to the another company as a family visa but the first sponsor still he is holding our passport.I have claimed to the police and the police forwarded the case to the public prosecution diplomatic area.     I worked in Bahrain for 2 months in 2014 but I left country without my documents i.e. My relieving letter and my degree those my employer kept with them when i joined. I wrote a mail asking send my documents back but din’t replied over it so is that any other way so i could do to get my documents back in India.

  37. Hi please I need help, I leave in my company for one year and I resign legally to my old company. But the problem they don’t want to gave my pasport back to and they don’t want to release me ,in their company. Now 7 months my visa expire but my old employer still paid evry monthly visa.
    And I file case for my employer because my pasport they don’t want to gave to me. Is not my intention to file a case. But my employer want me to pay also 1000bd because he said I have a loan with them. And I don’t have any loan to their company , please help me and make attention because they make illegal.
    Please help me, because I’m 7 months I don’t have work.

I just want to know if what my friend can do if his employer is not yet applying him for a working visa and permit he is under a endorsement visa and he is already working 1year in the shop already.. they said lmra usually have random checks in some areas or shops about having expired working permits or having no work visa or permits just want to know.   44. Dear Sir,
    I have worked for 1 company for more than 12 months.I worked as financial controller. However, they have given me all kinds of work like HR, Admin, visa processing, Secretarial, Purchase, their personal work etc. If you dont do other work they fire staff immediately. More than 20 staff fired in 1 year and force them to sign resignation. After all these when their purpose get served one day they gave me termination with immediate effect writing that i was unable to do my job in proper way i.e. accounting. They force me to do all these other work and hence i was unable to complete my real work which i was doing side by side.

    They didnt paid me my salary of 1 month and full settlement of indemnity and leave. Even they took signature from me in 1 letter by writing that i was unable to fulfil my duties properly. I signed because my settlement is pending with them. Now whenever i am calling them they are saying that they will check complete accounts and then pay me only. I want to know whether is there any procedure by which they must have raise some wrong complaint against me with LMRA (as they took backup of work done by me until my termination date) by mentioning i didnt complete my work.

    My questions are :-

    1. How i will come to know if they have made some complaints against me with LMRA?

    2. If LMRA will check entire accounting done by my team how long it will take??

    3. How can i get my money for settlement.???

    Please help and answer me as i am suffering lot after killing myself for these people by working so much hard for them.
